1. About these terms

These terms apply to your use of needlepointdiva.com (the "Site") operated by Needlepoint Diva ("we", "us"). By using the Site or buying a pattern, you agree to these terms. If you don't agree, please don't use the Site.

2. The Site is a catalog

The Site is a showcase for our patterns. We do not run checkout, accounts, payment processing, tax calculation or digital delivery on this domain. Those services are operated by Polar.sh ("Polar"), our Merchant of Record.

When you click "Buy now", your transaction is with Polar, not with us. Polar's terms apply to the purchase, payment, taxes and delivery of the file.

3. Products

All products sold on the Site are digital PDF downloads. No physical product will be shipped. Prices are shown in US dollars and include only what is described on the product page. Polar may add applicable consumer taxes (e.g. US sales tax, EU VAT) at checkout.

4. License to use a pattern

When you buy a pattern, you receive a non-exclusive, non-transferable license to:

• Stitch and finish as many pieces as you like, for yourself or as gifts.
• Sell finished pieces you make from the pattern, in small quantities, with credit to Needlepoint Diva.

You may not:

• Resell, share, sublicense or redistribute the PDF itself.
• Modify the chart and redistribute it as a new pattern.
• Use the pattern, our name or our artwork in any way that suggests endorsement of a product, brand or political position.

5. Refunds

Because files are delivered instantly and cannot be returned, all sales are final. If you didn't receive your file, contact us within 14 days and we'll resend it. See the full refund policy.

6. Intellectual property

All patterns, illustrations, photographs, the brand name "Needlepoint Diva", the logo and the Site itself are our intellectual property. Nothing on the Site grants you a right to use our name or marks without permission.

7. Acceptable use

You agree not to:

• Use the Site in any way that breaks applicable law.
• Attempt to interfere with the Site, scrape it, or use it to attack other systems.
• Misrepresent your identity or affiliation when contacting us.

8. Disclaimers

The Site and its content are provided "as is" and "as available". To the extent permitted by law, we disclaim all warranties, express or implied, including fitness for a particular purpose. We do our best to keep the Site accurate and available, but we can't guarantee uninterrupted or error-free operation.

9. Limitation of liability

To the extent permitted by law, Needlepoint Diva is not liable for any indirect, incidental or consequential damages arising from your use of the Site or any pattern. Our total liability for any claim related to a pattern is capped at the amount you paid for that pattern.

10. Changes

We may update these terms from time to time. The "Last updated" date at the top will reflect the change. Continued use of the Site after a change means you accept the new terms.

11. Governing law

These terms are governed by the laws of the State of Delaware, United States, without regard to its conflict-of-laws principles.
